Please find below a selection of recent legislation changes relating to COVID-19 and communications for workplaces from key safety and environmental regulators in Australia and New Zealand.

LEGISLATION CHANGES

Biosecurity (Human Coronavirus with Pandemic Potential) Amendment (No. 1) Determination 2021

  • Amends the Biosecurity (Human Biosecurity Emergency) (Human Coronavirus with Pandemic Potential) (Overseas Travel Ban Emergency Requirements) Determination 2020 to remove the automatic exemption for a person who ordinarily resides in another country and replace it with a discretionary exemption, and makes a consequential amendment to the Biosecurity (Entry Requirements - Human Coronavirus with Pandemic Potential) Determination 2020.

Child Care Subsidy Amendment (Coronavirus Response Measures No. 4) Minister’s Rules 2021

  • Amends the Child Care Subsidy Minister’s Rules 2017 to allow extra allowable absences for eligible individuals that are affected by COVID-19 lockdowns and stay at home orders which will ensure that families can continue to receive subsidised fee relief when their children are unable to attend care due to COVID-19 lockdowns or stay at home orders.

Defence Determination, Conditions of Service Amendment Determination 2021 (No. 6)

  • Amends the Defence Determination 2016/19, Conditions of Service relating to allowances and reimbursements, leave, housing and meals and warlike and non-warlike deployments.

Defence Determination, Conditions of Service Amendment Determination 2021 (No. 15)

  • Amends the Defence Determination 2016/19, Conditions of Service to provide benefits for members who are on a long-term posting overseas in response to, and recognition of, the additional difficulties experienced as a consequence of the COVID-19 pandemic in overseas locations.

Financial Sector (Collection of Data) (Reporting Standard) Determination No. 42 of 2021

  • Determines the Reporting Standard ARS 920.6 Australian Government Small and Medium Enterprise (SME) Recovery Loan Scheme - JobKeeper which sets out requirements for the provision of information to APRA relating to an authorised deposit-taking institution’s and registered financial corporation’s lending under the Australian Government SME Recovery Loan Scheme, to small and medium enterprises (SMEs) that received JobKeeper payments between 4 January 2021 and 28 March 2021.

Financial Sector (Collection of Data) (Reporting Standard) Determination No. 43 of 2021

  • Determines Reporting Standard ARS 920.8 Australian Government Small and Medium Enterprise (SME) Recovery Loan Scheme - Flood.

Therapeutic Goods (Serious Scarcity and Substitutable Medicine) (Tocilizumab) Instrument 2021

  • Identifies two medicines as being scarce medicines across the whole of Australia, and has the effect that each is specified as being substitutable for the other in the circumstances permitted in the Instrument.

Public Health (COVID-19 Areas of Concern) Notice 2021 (No 202)

  • Identifies COVID-19 affected areas, places of high concern and places of concern.

Public Health (COVID-19 Additional Restrictions for Delta Outbreak) Amendment (No 18) Order 2021

  • Extends particular restrictions applicable in relation to Greater Sydney to the City of Newcastle and certain other local government areas in the Hunter, makes additional provisions for the calculation of space for the Order in relation to construction sites, industrial premises, office premises and warehouses or distribution centres, and requires an occupier of premises in Greater Sydney not to allow more persons on the premises than the number of persons that is equivalent to 1 person per 4 square metres of space in the premises even if it results in less than 25 persons being allowed on the premises - came into force at 5 pm on 5 August 2021.

Public Health (COVID-19 Additional Restrictions for Delta Outbreak) Amendment (No 19) Order 2021

  • Extends particular restrictions to the Armidale Regional local government area - came into force at 5 pm on 7 August 2021.

Public Health (COVID-19 Additional Restrictions for Delta Outbreak) Amendment (No 20) Order 2021

  • Includes additional suburbs as a declared area to which particular additional restrictions apply, enables the CHO to specify, by notice published on the NSW Health website, parts of local government areas as affected areas and declared areas to which particular additional restrictions apply, and prohibits movement into declared areas for the purposes of locally obtaining food, goods or services - came into force at 5 pm on 8 August 2021.

Public Health (COVID-19 Additional Restrictions for Delta Outbreak) Amendment (No 21) Order 2021

  • Extends particular restrictions to the Tamworth Regional local government area - came into force at 5 pm on 9 August 2021.

Public Health (COVID-19 Additional Restrictions for Delta Outbreak) Amendment (No 22) Order 2021

  • Extends particular restrictions applicable in relation to Greater Sydney to the Northern Rivers - came into force at 6 pm on 9 August 2021.

Public Health (COVID-19 Additional Restrictions for Delta Outbreak) Amendment (No 23) Order 2021

  • Makes further provision in relation to construction sites in certain areas of Greater Sydney.

Public Health (COVID-19 Additional Restrictions for Delta Outbreak) Amendment (No 24) Order 2021

  • Extends certain restrictions applicable to Greater Sydney to the Dubbo Regional local government area, and clarifies the application of restrictions in other regional areas to which they apply concerning persons staying at caravan parks and camping ground and exemptions.


COVID-19 Directions (No. 38) 2021: Directions for Further Border Restrictions

  • Prohibits entry to the NT by certain persons who have been in a COVID-19 hotspot of public exposure site.

Border Restrictions Direction (No. 32)

  • Prohibits persons from entering Queensland if they have been in a COVID-19 hotspot unless permitted by the direction, and sets the entry requirements for border zone residents, among other things.

Queensland COVID-19 Restricted Areas (No. 20)

  • Identifies Queensland COVID-19 restricted areas for the Public Health Direction - Residential Aged Care Direction (No. 3), the Public Health Direction - Disability Accommodation Services (No. 21), and the Public Health Direction - Hospital Entry (No. 2), or their successors.

Restrictions for Impacted Areas (No. 12) (SEQ Eased Restrictions Stage 1) Direction

  • Restricts movement and gatherings, requires face masks to be carried and worn in certain circumstances, and restricts certain businesses, activities and undertakings in certain impacted areas, among other things.

Restrictions for Locked Down Areas (Cairns and Yarrabah) Direction

  • Restricts the number of people who may gather in homes or public places in a locked down area of Cairns Regional Council and Yarrabah Aboriginal Shire Council, the reasons for leaving home, and who may enter or leave a locked down area, and restricts how certain businesses must operate or whether businesses can operate in the locked down areas.

Restrictions on Businesses, Activities and Undertakings Direction (No. 24)

  • Restricts the operation of certain businesses, activities and undertakings, and requires certain information to be provided and collected using the Check In QLD app.

Emergency Management (Activities - Associated Direction No 7) (COVID-19) Direction 2021

  • Declares the whole of SA to be a declared area subject to level 2 restrictions, and modifies the Emergency Management (Activities - General No 3)(COVID-19) Direction 2021.

Emergency Management (COVID-19) (Supervised Quarantine No 10) (COVID-19) Direction 2021

  • Imposes testing, vaccination, employment and other requirements for certain employees and contractors, and imposes requirements for persons undertaking supervised quarantine, among other things.

Emergency Management (Cross Border Travel - Associated Direction No 39) (COVID-19) Direction 2021

  • Imposes cross-border requirements on certain overseas and interstate arrivals, declares restricted zones and prescribed roads, and modifies the General Direction, among other things.



Extension of Emergency Declaration

  • Extends the period during which public health emergency is in force for a further 12 weeks.


Area Directions (No. 13)

  • Identifies areas within Victoria which have a higher prevalence of, or risk of exposure to, SARS-CoV-2 and which are subject to specific directions which are reasonably necessary to protect public health - came into force at 11:59 pm on 9 August 2021.

Care Facilities Directions (No. 40)

  • Provides for restricted access to care facilities in order to limit the spread of COVID-19 within a particularly vulnerable population - came into force at 8:00 pm on 5 August 2021.

Commercial Tenancy Relief Scheme Act 2021

  • Temporarily empowers the making of regulations to modify the application of the law of Victoria in relation to certain commercial leases and licences for the purpose of responding to the COVID-19 pandemic.

Restricted Activity Directions (Metropolitan Melbourne) (No. 7)

  • Restricts the operation of certain businesses and undertakings in Metropolitan Melbourne to address the serious public health risk posed to Victoria by COVID-19 - came into force at 11:59 pm 9 August 2021.

Restricted Activity Directions (Regional Victoria) (No. 7)

  • Restricts the operation of certain businesses and undertakings in Regional Victoria to address the serious public health risk posed to Victoria by COVID-19 -came into force at 11:59 pm 9 August 2021.

Stay at Home Directions (Metropolitan Melbourne) (No. 2)

  • Requires residents of Metropolitan Melbourne to limit their interaction with others by restricting when they may leave their residence, restricting public and private gatherings and requiring face coverings to be worn indoors and outdoors - came into force at 11:59 pm 9 August 2021.

Stay Safe Directions (Regional Victoria) (No. 7)

  • Imposes restrictions for residents of Regional Victoria by restricting when they may leave Regional Victoria, restricting public and private gatherings and requiring face coverings to be carried and worn in certain circumstances - came into force at 11:59 pm 9 August 2021.

Victorian Border Crossing Permit Directions (No. 27)

  • Continues to provide a ‘traffic light’ border crossing scheme for persons seeking to enter Victoria from any other State or Territory in Australia or, after entering Australia from a Green Zone Country in order to limit the spread of COVID-19 - came into force at 11:59 pm 9 August 2021.

Workplace (Additional Industry Obligations) Directions (No. 36)

  • Establishes additional specific obligations on employers and workers in specific industries in relation to managing the risk associated with COVID-19 - came into force at 11.59 pm 9 August 2021.

Workplace Directions (No. 42)

  • Limits the number of Victorians attending Work Premises to assist in reducing the frequency and scale of COVID-19 outbreaks in Victorian workplaces and establishes more specific obligations on employers and workers in relation to managing the risk associated with COVID-19 - came into force at 11:59 pm 9 August 2021.


Extension of Declaration (No. 2) of Public Health State of Emergency

  • Extends the public health state of emergency declaration for a period of 14 days.


COVID-19 Public Health Response (Air Border) Order (No 2) Amendment Order (No 9) 2021

  • Removes references to Australia from the definitions of QFT place and QFT carrier, as there are no longer quarantine-free travel flights from Australia to New Zealand.

COVID-19 Public Health Response (Exemptions and Conditions for Quarantine-free Travel) Amendment Notice (No 16) 2021

  • Ends all possibility of quarantine-free travel flights from Australia to New Zealand.

COVID-19 Public Health Response (Managed Isolation and Quarantine Charges) Amendment Regulations (No 2) 2021

  • Authorises the relevant Minister to waive the prescribed charges for a class of persons in 2 situations.

COVID-19 Public Health Response (Required Testing) Amendment Order (No 3) 2021

  • Allows affected persons to undergo recurring saliva testing for COVID-19 as an alternative to undergoing testing and medical examination under Clause 7 of the COVID-19 Public Health Response (Required Testing) Order 2020.
